Agreement to Terms

By accessing or using Daily Ping, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, then you may not access the service.

Daily Ping is operated by Luke Orriss, a sole trader trading as Orriss Co. These terms govern your use of our minimalist habit tracking service.

Description of Service

Daily Ping is a web-based habit tracking tool that allows you to:

  • Set a daily question or goal to track
  • Answer with a simple Yes or No each day
  • Build and maintain streaks
  • Receive email reminders (if enabled)
  • Export your data at any time

We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice.

User Accounts

To use Daily Ping, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information when creating your account
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You are responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

Acceptable Use

You agree not to:

  • Use the service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the service or any related systems
  • Interfere with or disrupt the service or servers connected to the service
  • Use automated systems (bots, scrapers, etc.) to access the service without permission
  • Transmit any viruses, malware, or other harmful code
  • Use the service to harass, abuse, or harm others
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

Violation of these terms may result in immediate termination of your account.

Your Content and Data

You own all content and data you create using Daily Ping.

By using the service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you.

You retain all rights to your data and can export or delete it at any time. We do not claim ownership of your content.

You are solely responsible for the content you create and ensure it does not violate any laws or infringe on any third-party rights.

Free and Premium Services

Daily Ping offers both free and premium subscription options:

Free Service

The free service allows you to use Daily Ping with basic features. We reserve the right to modify or limit free service features at any time.

Premium Service

Premium subscriptions are billed on a recurring basis. By subscribing, you agree to pay the subscription fee and authorize automatic renewal unless you cancel.

You can cancel your subscription at any time. Cancellation will take effect at the end of your current billing period.

Refunds

Refund requests are handled on a case-by-case basis. Contact us at help@dailyping.app if you believe you are entitled to a refund.

Service Availability

We strive to provide reliable service, but we do not guarantee that Daily Ping will be available 100% of the time. The service may be unavailable due to:

  • Scheduled maintenance
  • Technical issues or outages
  • Force majeure events
  • Updates or modifications

We are not liable for any loss or inconvenience resulting from service unavailability.

Limitation of Liability

Daily Ping is provided "as is" and "as available" without warranties of any kind, either express or implied.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Indemnification

You agree to indemnify and hold harmless Daily Ping, Orriss Co (sole trader), and its operator from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, violation of these terms, or infringement of any rights of another.

Termination

We may terminate or suspend your account immediately if:

  • You violate these Terms of Service
  • You engage in fraudulent or illegal activity
  • You abuse the service or other users
  • Required by law or legal process

You may terminate your account at any time by deleting it through your account settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by:

  • Posting the new Terms of Service on this page
  • Updating the "Last updated" date at the top
  • Sending you an email notification for significant changes

Your continued use of Daily Ping after any changes constitutes acceptance of the new Terms of Service.

These Terms of Service shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these terms or your use of the service shall be resolved through appropriate legal channels.

Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
